Sweet Me Photography’s Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Sweet Me Photography website (“Site”) and the photography services provided by Sweet Me Photography, Inc. (“Sweet Me Photography,” “SMP,” “we,” “us,” or “our”). By accessing the Site, submitting an inquiry or reservation form, booking a session, or making a payment, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or book services.

1. Booking & Agreement to Services

By booking a photography session through this Site, you are entering into a legally binding agreement with Sweet Me Photography for the services selected. These Terms apply to both use of the Site and all photography services purchased, in addition to any session confirmations, invoices, or written communications. Clients must be at least 18 years old or the legal guardian of the minor being photographed.

2. Client Information & Privacy

When submitting an inquiry, reservation form, or booking a session, Clients agree to provide accurate, current, and complete information. Client information is used solely for purposes related to booking, communication, service delivery, and account management, and is handled in accordance with Sweet Me Photography’s Privacy Policy. Any personal contact information shared between Sweet Me Photography, its photographers, and Clients may only be used for purposes directly related to the booked session. Misuse of personal information is prohibited.

3. Text Message Communications

Users may choose to provide Sweet Me Photography with a mobile phone number as part of the inquiry, reservation, or booking process. By providing a mobile phone number, Clients consent to receive text message communications from Sweet Me Photography related to inquiries, bookings, session details, reminders, delivery notifications, or other service-related communications. Sweet Me Photography does not charge for sending text messages, however, standard message and data rates may apply based on the Client’s mobile carrier. Clients may opt out of text message communications at any time by notifying Sweet Me Photography or following opt-out instructions included in the message.

4. Session Reservation, Payment & Fees

All sessions require a completed reservation form and payment to secure a date and time. Pricing, packages, inclusions, and exclusions are clearly outlined at the time of booking and/or invoicing. Failure to complete payment may result in cancellation of the session without notice.

5. Rescheduling, Cancellations & Refunds

Clients may reschedule their session or request a full refund by providing at least seventy-two (72) hours’ notice prior to the scheduled session start time. Requests made with less than 72 hours’ notice, including no-shows, are not eligible for a refund and may require a new booking and payment to secure a future date. Sweet Me Photography reserves the right to reschedule or cancel a session due to illness, emergency, unsafe conditions, or circumstances beyond our control.

6. Image Delivery & Turnaround Time

  • Proof galleries are delivered approximately eight (8) days after the photography session.
  • Final, professionally retouched images are delivered approximately eight (8) days after the Client places their image order.
Delivery timelines are estimates and may vary slightly.

7. Copyright, Proof Images & Image Use

All photographs, including proofs and final images, are the exclusive copyrighted property of Sweet Me Photography, Inc. and/or its assigned photographer. Proof images are watermarked and provided for selection only. Downloading, screenshotting, sharing, or removing watermarks is prohibited and may result in legal action. Purchased images include a non-exclusive, non-transferable license for personal use only. Commercial use requires a separate written license.

8. Ordering & Retouching Policy

All images must be ordered through Sweet Me Photography and professionally retouched by our team. Raw, unedited, or unretouched images are never released under any circumstances.

9. Client Conduct During Sessions

No photography, video recording, or image capture by Clients or guests is permitted during the session without prior written permission. This includes photographing behind or alongside the Photographer or attempting to recreate poses or setups. Sweet Me Photography and its photographers may pause or terminate the session and leave the premises if unauthorized photography occurs. No refund will be issued.

10. Photographer Safety & Home Environment

Clients are responsible for providing a safe and suitable environment, including securing pets, supervising children, and maintaining clear space around equipment. Sessions may be paused or terminated without refund if unsafe conditions exist. Clients agree to indemnify Sweet Me Photography for injuries or damages arising from unsafe conditions.

11. Parent or Legal Guardian Presence Requirement

For all sessions involving minors, a parent or legal guardian must be present at all times. Failure to comply may result in termination of the session without refund.

12. Marketing & Promotional Image Use

Marketing or promotional use of images is not automatic and is governed solely by the Client’s opt-in or opt-out selection made in the reservation form.

13. Circumvention of Services

Clients may not bypass or attempt to bypass Sweet Me Photography’s booking, messaging, or payment systems.

14. Prohibited Uses

Users may not misuse the Site or Services, including attempting unauthorized access, introducing malware, or reverse-engineering Site functionality.

15. Digital Millennium Copyright Act (DMCA)

16. Intellectual Property, Website Content

All Site content, including text, images, logos, and design elements, is owned by Sweet Me Photography and may not be used without written permission.

17. Limitation of Liability

Sweet Me Photography’s total liability for any claim shall not exceed the amount paid for the session giving rise to the claim.

18. Indemnification

Clients agree to indemnify and hold harmless Sweet Me Photography from claims arising from Client conduct or unsafe conditions.

19. Severability

If any provision is held unenforceable, the remaining provisions shall remain in effect.

20. Entire Agreement

These Terms, together with the Privacy Policy and any applicable session agreement, constitute the entire agreement between the parties.

21. Governing Law & Venue

These Terms are governed by California law. Any legal action shall be brought exclusively in San Diego County, California.

22. Changes to These Terms

Sweet Me Photography may update these Terms at any time. Continued use constitutes acceptance.
